BRB2K Terms and Conditions
These Terms and Conditions ("Terms") govern your use of BRB2K, a nostalgic instant-messaging app where users chat with fictional AI personas for entertainment. By accessing or using BRB2K, you agree to these Terms and to our Privacy Policy.
BRB2K is for entertainment purposes only. AI buddies are fictional software experiences, not real people, professionals, emergency responders, therapists, financial advisers, lawyers, or substitute caregivers.
1. Eligibility
You must be at least 13 years old to use BRB2K. If you are under the age of majority where you live, you may use BRB2K only with permission from a parent or legal guardian.
2. Accounts and Security
You are responsible for your account, screen name, Device Key, device security, recovery email, and activity under your account. You must provide accurate account and recovery information and must not impersonate another person, reserve names in bad faith, or attempt to access another user's account.
3. AI Personas and AI Answers
BRB2K uses artificial intelligence to generate fictional chat responses and related app behavior. AI outputs may be inaccurate, incomplete, offensive, unexpected, emotionally persuasive, or unsuitable for your circumstances. BRB2K does not provide medical, legal, financial, mental-health, safety, relationship, employment, education, or other professional advice. Do not use BRB2K for emergencies, crisis support, diagnosis, treatment, legal decisions, financial decisions, or situations where inaccurate information could cause harm.
AI personas may simulate memory, presence, mood, typing behavior, away states, trivia behavior, and conversation continuity. These features are part of the entertainment experience and should not be understood as human relationships, professional services, factual representations, or promises that a persona actually knows, remembers, feels, or intends anything.
4. User Content
You retain ownership of messages and other content you submit to BRB2K ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and create AI responses from User Content as needed to operate, secure, moderate, improve, and support BRB2K. This license does not give us ownership of your User Content.
You are responsible for your User Content and for ensuring you have the rights needed to submit it. Do not submit confidential, highly sensitive, illegal, or third-party information unless you have the right to do so and understand the risks.
5. User-to-User Features
BRB2K is currently focused on AI persona chats. BRB2K may later offer features that allow users to communicate with other users, such as peer-to-peer chat, profiles, friend requests, groups, or shared content areas. If you use those features, your messages, profile information, screen name, and other content may be visible to the users you choose to interact with. Other users may copy, save, screenshot, report, or share content you send, so you should not share sensitive personal information, passwords, financial information, private images, or anything you would not want another person to keep.
User-to-user messages are not guaranteed to be private or end-to-end encrypted unless we expressly say otherwise in the app. We may store, process, filter, review, remove, or disclose user-to-user content when reasonably necessary to operate BRB2K, investigate abuse, enforce these Terms, protect users, comply with law, or respond to reports and support requests.
You may not use user-to-user features to harass, threaten, bully, exploit, groom, impersonate, dox, spam, defraud, or abuse anyone, or to send illegal, hateful, sexually exploitative, violent, or otherwise harmful content. We may remove content, restrict messaging, block accounts, preserve evidence, report unlawful conduct, or terminate accounts when we believe it is necessary for safety, legal compliance, or service integrity.
6. Acceptable Use
You agree not to use BRB2K to:
- Harass, threaten, bully, stalk, dox, abuse, exploit, groom, sexualize, or harm others.
- Create, request, or distribute illegal, hateful, violent, sexually exploitative, non-consensual intimate, abusive, or extremist content.
- Create, request, distribute, or attempt to obtain child sexual abuse material, child sexual exploitation content, sexualized depictions of minors, or grooming content, including fictional, AI-generated, role-play, text, image, audio, coded, or disguised versions.
- Encourage, instruct, or glorify self-harm, suicide, eating disorders, terrorism, violent extremism, violence against others, or dangerous illegal activity.
- Create or share sexual deepfakes, non-consensual intimate images, impersonations, scams, phishing attempts, malicious links, spam, or fraudulent content.
- Solicit or disclose passwords, authentication codes, financial account numbers, government IDs, private keys, or similar secrets.
- Submit personal information about another person without a lawful basis or their permission.
- Use BRB2K for professional advice, emergency response, diagnosis, treatment, or decisions that could materially affect someone's rights, safety, finances, health, or employment.
- Reverse engineer, scrape, overload, probe, attack, bypass rate limits, evade safety systems, or misuse our infrastructure or AI providers.
- Use BRB2K to develop competing models or services where prohibited by applicable provider terms or law.
7. Child Safety
BRB2K has zero tolerance for child sexual abuse material, child sexual exploitation, grooming, or attempts to sexualize minors. This applies to real, fictional, AI-generated, text-based, role-play, image, audio, coded, or disguised content. We may immediately remove content, suspend or terminate accounts, preserve evidence, and report suspected violations to law enforcement, NCMEC, or other appropriate authorities where required or appropriate.
8. Moderation, Safety, and Enforcement
We may investigate suspected misuse, review reported content, restrict features, suspend accounts, delete content, preserve records, or terminate access where we believe it is necessary to protect users, BRB2K, service providers, or the public. We may also report unlawful activity when required or appropriate.
9. Subscriptions and Purchases
Some features may require a paid subscription or in-app purchase. BRB2K may offer Basic and Plus subscriptions, monthly or annual plans, free trial limits, monthly chat-credit allowances, and optional usage packs. Credits are app-specific usage units, have no cash value, are not a stored-value account or gift card, and may expire or reset at the end of the applicable usage cycle. Usage packs require an active usage cycle and are added to the current cycle unless the purchase screen says otherwise.
Purchases are processed by the applicable app store and managed through RevenueCat. Subscription terms, renewal, cancellation, refunds, restore behavior, billing, taxes, and chargebacks are governed by the app store rules and the purchase screen shown at the time of purchase. You can manage or cancel subscriptions through your app store account settings. Deleting BRB2K account data does not automatically cancel an app store subscription.
10. Availability and Changes
BRB2K may change, suspend, or discontinue features at any time. AI providers, app stores, Firebase, Cloudflare, RevenueCat, OpenAI, Anthropic, and other third-party services may affect availability. We may update personas, safety systems, limits, credit pricing, credit allowances, subscription features, and app behavior without notice where reasonably necessary.
11. Intellectual Property
BRB2K, including its software, design, branding, text, graphics, sounds, personas, and other materials, is owned by Better Things Better or its licensors and is protected by intellectual property laws. These Terms do not grant you ownership of BRB2K or permission to copy, modify, distribute, sell, or reverse engineer it except as allowed by law.
12. Privacy
Our Privacy Policy explains how we collect, use, store, share, and delete information, including conversation content, AI processing data, purchase status, and usage-credit records. By using BRB2K, you acknowledge that your messages and related feature data may be processed by us and our service providers to provide AI responses and related features.
13. Third-Party Services
BRB2K relies on third-party services such as Firebase, Cloudflare, Anthropic, OpenAI, RevenueCat, and app store providers. Your use of BRB2K may also be subject to their terms, policies, and technical limits.
14. Termination
You may stop using BRB2K at any time and may use available in-app controls or contact us to request deletion as described in the Privacy Policy. Account deletion may remove your screen name, profile data, chats, memories, usage records, and account records from BRB2K systems, but it does not cancel app store subscriptions or remove records retained by app stores, RevenueCat, logs, backups, or systems that must retain limited information for legal, payment, tax, security, dispute, or abuse-prevention reasons. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, abuse the service, or if we discontinue BRB2K.
15. Disclaimers
BRB2K is provided "as is" and "as available" for entertainment purposes only. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of accuracy, reliability, usefulness, emotional suitability, merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.
16. Limitation of Liability
To the fullest extent allowed by law, Better Things Better and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or business interruption arising from or related to BRB2K or these Terms.
17. Indemnity
You agree to defend, indemnify, and hold harmless Better Things Better from claims, damages, liabilities, losses, and expenses arising from your misuse of BRB2K, your User Content, your violation of these Terms, or your violation of law or third-party rights.
18. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, unless your local law requires otherwise. Courts located in California will have exclusive jurisdiction, except where applicable law gives you the right to bring claims elsewhere.
19. Changes to These Terms
We may update these Terms as BRB2K changes. If changes are material, we will provide notice as appropriate. Continued use of BRB2K after updated Terms become effective means you accept the updated Terms.
